MarkClear — Article 50 marking & disclosure

Your chatbot has been breaking EU law since August 2. We fix it in 7 days.

MarkClear finds every AI touchpoint your customers touch — chatbots, AI images, voice agents, AI-written posts — writes the exact Article 50 disclosure for each one, gives your developer paste-ready code, and hands you an evidence pack a customer, regulator or lawyer can actually check. Done for you. Flat price. Before the December 2 marking deadline.

Article 50 of the EU AI Act has applied since 2 August 2026. If your AI talks to people, makes content, or reads emotions, you owe disclosures, labels and machine-readable marks. The marking deadline for systems already live is 2 December 2026.

What do you owe for this touchpoint?

Pick the AI touchpoint. You get its Article 50 paragraph and its duty — no account, no email before the result. This checker classifies a touchpoint type; it does not scan your site.

Article 50(1) — disclosure required

Inform the person, at first interaction in a clear and distinguishable manner, that they are interacting with an AI system.

Sample copy: “You are chatting with Support Bot, an AI assistant — not a human. It can make mistakes. Ask for a person at any time.”

The problem

A visible label is not a mark

Most sites added AI quietly: a support bot here, AI product photos there, an AI blog writer. Nobody labelled any of it — because until August, nobody had to. The fix is small; proving you did it, touchpoint by touchpoint, is the work.

A visible label is not a mark

Article 50(2) requires a machine-readable mark — metadata or a provenance sidecar. A visible “AI-generated” label answers the separate 50(4) duty in the cases it applies. The Fix Pack ships both.

The exposure

Non-compliance: up to €15M or 3% of worldwide turnover (for SMEs, whichever is lower). Misleading an authority: €7.5M or 1%.

The deadline did not move

The Digital Omnibus (Regulation (EU) 2026/1744) moved the Annex III high-risk duties to Dec 2027 / Aug 2028. Article 50 did not move — it has applied since 2 August 2026, and Commission guidelines were issued 20 July 2026.

No platform to learn. No €499/mo governance suite. No law-firm project. Platforms give you a dashboard to fill in. We hand you the finished fix.

How it works

Inventory to evidence in 7 days

1

Inventory (days 1–2)

Every AI touchpoint found and classified to 50(1)/(2)/(3)/(4).

2

Fix pack (days 3–5)

Disclosure wording, accessible paste-ready HTML snippet, visible-label copy, machine-readable provenance sidecar.

3

Evidence (days 6–7)

The timestamped pack: touchpoint, duty, wording, snippet hash, deployment URL, verification date.

4

Sentinel (monthly)

Re-scan, diff, refresh — new AI features flagged before they ship unlabelled.

The Fix Pack

What the Fix Pack physically contains

1Disclosure copy per touchpoint, written for the actual surface

3Label kit for the 50(4) duties
4Machine-readable provenance sidecars (SHA-256 content hash)
5Evidence pack with hashes and verification dates

The evidence pack

The deliverable is a register, not a dashboard

Honest scope

We are operational tooling, not your lawyer.

MarkClear is operational evidence tooling. It is not legal advice, not a law firm, and not a compliance certificate. Have counsel review before relying on it. A visible label is not the 50(2) marking duty. Disclosed limits: the scanner checks fetched HTML — JS-rendered disclosures may need a rendered check; sidecars record and hash the mark — full C2PA manifest embedding is a Fix Pack v2 item. We never claim certification or “compliance guaranteed”.

Is this legal advice?

No. MarkClear is operational implementation and evidence tooling, built on the published Article 50 text and the Commission's July 2026 guidelines. Have counsel review before relying on it for a regulated or high-risk use — we say so in every pack.

What counts as a touchpoint?

One AI surface a person meets: one chatbot, one voice agent, one class of generated content (e.g. AI product images), one emotion/biometric feature, one AI-text publication channel.

The marking deadline is 2 December 2026. It has not moved.
