FAQ

Questions, answered from the records

The Article 50 questions buyers actually ask — including the one about labels.

Is this legal advice?

No. MarkClear is operational implementation and evidence tooling, built on the published Article 50 text and the Commission's July 2026 guidelines. Have counsel review before relying on it for a regulated or high-risk use — we say so in every pack.

What counts as a touchpoint?

One AI surface a person meets: one chatbot, one voice agent, one class of generated content (e.g. AI product images), one emotion/biometric feature, one AI-text publication channel.

What if our AI use is purely internal?

Then Article 50 mostly doesn't bite — the Audit will say so, in writing, and that's the cheapest peace of mind you'll buy this year.

Does a visible “AI-generated” label satisfy the marking duty?

No — 50(2) requires a machine-readable mark; the visible label answers the separate 50(4) disclosure duty. Fix Pack ships both.

What about text our team heavily edited?

Substantive human review + editorial responsibility can take public-interest text out of the 50(4) duty. Our workflow records that review properly — a grammar pass does not count, and our pack will not record it as if it does.

Wasn't the AI Act delayed?

High-risk duties were (Digital Omnibus, Regulation (EU) 2026/1744, to Dec 2027 / Aug 2028). Article 50 transparency was not — it has applied since 2 August 2026, and the marking grace ends 2 December 2026.
